Intellectual Property in Socialist Transition

The aim of this study is to demonstrate the need of enhancing intellectual property as a mechanism for generating incentives in scientific creation under socialist transition conditions in Cuba. Characteristics and principal dilemmas in ideas production, the fundamental types of intellectual property and its performance in capitalist countries, as well as its situation and improvement in Cuba socialist economy are dealt with. Conclusions show the unacceptability of the fact that an individual can decide when implementing his own idea for the benefit of society. W hat is fair is recognizing his contribution as one well above the standard. There is no coherent and rational reason supporting an absence of payment for a researcher's effort in solving a social problem. However, payment for a contribution must agree with the improvement of society well- being as a whole. One of the short-terms priorities of the Cuban State must be the objective and non-prejudiced review of the protective system of intellectual property rights concerning scientific research.
